Does My Subcontractor Need to Carry Workers Compensation in ...

Over the past few years, one of the biggest frustrations from both general contractors and subcontractors in the state of Illinois has been the issue of workers compensation.

This is how many contractors feel when they are told the must carry workers compensation even if they have no employees

General contractors can use subcontractors for many different jobs and projects. ?The subcontractors they use can range from million dollar corporations to a one-man electrical contractor.

Insurance companies in Illinois are have and will include subcontractors costs as payroll if those subcontractors do not show proof of workers compensation insurance. ?It doesn?t matter if they have 100 employees or no employees.

For the larger subcontractors this is not an issue. ?They have employees and thus carry workers compensation insurance that will satisfy this requirement. ?The problem arises for the small one-man subcontractor who has never carried workers compensation insurance and is now being told they must obtain this coverage.

Why this is so important?

If you are using subcontractors for?any work in the state of Illinois and your subcontractor does not show proof of workers compensation at audit, you could very likely owe a large amount of money.

Let?s say you used a carpenter for several projects throughout the year. ?The subcontractor is a one-man shop and has never carried workers compensation. Due to the fact that they have no employees and you have worked with them before, you don?t even question it. ?You paid them $10,000 throughout the year and now it?s time for your audit. ?The friendly (ok, maybe sometimes not so friendly) auditor explains that unless you show proof that this carpenter had workers compensation, you will owe an additional $2,500 ($25 rate/per $100). ?How would feel? ?Let me tell you. ?Pissed off.

Do I think this is fair? ?Nope

Do I like that my general contractor clients have to ask both new and long-term subcontractors to buy a policy just to protect themselves? ?Nope

It?s very frustrating for all parties involved. ?The general contractor is annoyed because they have to ask their subcontractor to do something they may not want to do. ?The subcontractor is annoyed because they are being forced to buy a policy that in many cases provides no real protection. ?Finally, it is annoying for the insurance agent because it causes frustrations and extra time to explain this whole process.

I don?t necessarily fault the insurance companies. ?The reality is that is that if a subcontractor gets hurt, they can often collect?reimbursement?under the general contractor?s workers compensation policy. ?At this time in Illinois, having the subcontractor carry their own workers compensation policy is the best way to avoid this from occurring.

I know that there are still many subcontractors who do not carry workers compensation in Illinois and work for general contractors who do not require them to carry workers compensation. ?They may never have experienced a negative audit. ? The reality is that insurance companies are not identical and will not audit the same way. ?This means that some will fall between the cracks and no one will ever know.

My job as an agent is to education my clients for the potential pitfalls and help them identify potential risks and exposures. ?I am fully aware that this doesn?t make everyone happy, but my duty is and always will be with my client.

I would much prefer to explain this situation up front and not obtain?an account vs. masking it and having my client get slammed with a large audit the following year.

So, if you subcontract work, should you require the subcontractor to carry workers compensation? ?The answer is YES.

Convert Video Files Into Comic Book Style Ebooks for Offline ReadingYou can't always sit around watching video, but that doesn't mean you want to lose track of your favorite TV seasons. To solve this problem, blog Frisnit Electric Industrial Co. Ltd. devised a system to convert video from BBC's iPlayer into a comic book style text that can be read on a Kindle.

The basic process for conversion is a little complicated, but the payoff is a clever way to make your own photonovel. Frisnit's guide is made with iPlayer in mind, and uses Project X for subtitle conversion, lav2yuv to create the scenes, and FFmpeg to convert everything. Second-quarter growth revised up, Fed still seen in play

WASHINGTON (Reuters) - The economy fared slightly better than initially thought in the second quarter, but the pace of growth remained too slow to shut the door on further monetary easing from the Federal Reserve.

Gross domestic product expanded at a 1.7 percent annual rate, the Commerce Department said on Wednesday, as stronger export growth offset a pull-back in restocking by businesses wary of sluggish domestic demand.

While that was an improvement on the government's first estimate of 1.5 percent published last month and the composition of growth was fairly favorable, it was insufficient to cut into an unemployment rate that ticked up to 8.3 percent in July.

The lack of stronger job growth, along with the uncertainty stemming from Europe's debt crisis and fears of big U.S. government spending cuts and tax hikes in 2013, could compel the U.S. central bank to offer additional stimulus by year end.

"I don't think this really changes the dovish sentiment of the Fed," said Michael Hanson, a senior economist at Bank of America Merrill Lynch in New York. "They are going to look at this and say 1.7 percent is below trend, that's not where we want to be and the risks going forward are still material."

A growth pace of between 2 percent and 2.5 percent is generally seen as needed just to hold the jobless rate steady, and the sluggish recovery is proving to be a difficult hurdle for President Barack Obama in his quest to secure a second term in November's election.

Growth in the third quarter is expected to show an improvement, but still remain below the economy's potential.

A second report showed contracts to buy previously owned homes hit their highest level in more than two years in July, suggesting the housing market's recovery was gaining traction and offering a relative economic bright spot.

The lackluster recovery has sparked a sharp debate among Fed officials over whether they should launch another round of bond purchases to spur stronger growth.

Economists say the outcome of the central bank's next meeting on September 12-13 will be a close call. Jobs growth has picked up a bit and housing and retail sales have strengthened. However, business spending looks weak and inflation is slowing.

Fed Chairman Ben Bernanke could offer more clarity on the outlook for monetary policy when he speaks at a gathering of central bankers in Jackson Hole, Wyoming, on Friday.

"Growth is neither strong enough for Bernanke to take any additional easing off the table, but it is hardly weak enough to force him to announce new actions," said Joel Naroff, chief economist at Naroff Economic Advisors in Holland, Pennsylvania.

The Fed's Beige Book report, which offers a snapshot of the economy, described economic activity as continuing to "gradually" expand in July and early August. It noted, however, that manufacturing activity was softening in many regions of the country.

Stocks on Wall Street were little changed for a third straight day as investors opted to wait for Bernanke's speech. Treasury debt prices fell, while the dollar eked out modest gains versus a basket of currencies.

EXPORTS ECLIPSE INVENTORIES

The revised GDP data showed export growth was strong, while import growth was the smallest in a year. Trade contributed 0.32 percentage point to GDP growth instead of subtracting a third of a point, as previously reported.

"We expect softer export growth over the coming quarters, but not a collapse because the majority of exports stay in North America (and) will be insulated from what's going on in Europe and China," said Paul Edelstein, an economist at IHS Global Insight in Lexington, Massachusetts.

The export strength helped to offset the drag from inventories. However, the careful management of stocks could be a boost to the economy in the third quarter.

Excluding inventories, GDP rose at a 2.0 percent rate rather than 1.2 percent.

Consumer spending, which accounts for about 70 percent of U.S. economic activity, was revised up a notch to a 1.7 percent pace from the previously reported 1.5 percent. Still, that marked a step-down from the first quarter's 2.4 percent pace, and a smaller rise is expected this quarter with demand for big-ticket items such as automobiles cooling.

Stronger than previously reported investment in the construction of nonresidential structures also gave a lift to GDP growth in the second quarter.

But growth in business investment in equipment and software was lowered to a 4.7 percent pace, the slowest since the third quarter of 2009, from 7.2 percent previously.

Growth in spending by businesses on equipment and software has slowed sharply from a peak of 18.3 percent in the third quarter of last year, and the retrenchment appears to have intensified early this quarter.

"There's no question that as we look toward the end of the year and the risk presented by federal spending cuts and tax increases, the economy remains in a vulnerable window," said Jim Baird, chief investment strategist at Plante Moran Financial Advisors in Kalamazoo, Michigan.

The report also showed that after-tax corporate profits rose at a 1.1 percent rate after sinking 8.6 percent in the first quarter.

Government spending declined, but the drop was not as deep as previously reported. And even though consumer spending was bumped up, inflation pressures remained muted.

Strong candidate for possible single-dose malaria cure discovered

ScienceDaily (Aug. 28, 2012) ? A recently discovered compound from the aminopyridine class, code named MMV390048, caused quite a stir at the MMV Expert Scientific Advisory Committee (ESAC) meeting in Toulouse, France. The compound shows potent activity against multiple points in the malaria parasite's lifecycle.

This means that it not only has the potential to become part of a single-dose cure but might also be able to block transmission of the parasite from person to person. On this basis it was selected by MMV's ESAC for further development -- making it the first compound researched on African soil to enter preclinical development in partnership with MMV.

The aminopyridine series was initially identified by Griffith University scientists in Australia as part of MMV's extensive malaria screening campaign of around 6 million compounds. A team of scientists from the University of Cape Town's (UCT) Drug Discovery and Development Centre (H3-D) in South Africa, led by Prof. Kelly Chibale then scrutinised and explored the antimalarial potential of the series further.

With parasitological and pharmacological support from the Swiss Tropical and Public Health Institute and Monash University, respectively, Kelly's team selected the most promising compounds from the series to be optimized and re-tested. In just 18 months the team had identified and developed a candidate suitable for preclinical development.

    (AP) ? After what could have been the last match of Kim Clijsters' career ? and, instead, might one day be remembered as the first significant match of Victoria Duval's ? the two players posed in the locker room for a photo.

    No, it wasn't the 16-year-old Duval who requested the picture.

    It was the 29-year-old Clijsters who wanted a snapshot.

    "I thought that was so nice, because I was the one that should be begging her for a picture," Duval said, giggling all the while. "She's definitely my idol."

    There are, it's fair to say, plenty of other up-and-coming tennis players who feel that way about Clijsters, who extended her U.S. Open winning streak to 22 matches by beating wild-card recipient Duval 6-3, 6-1 on Monday night in Arthur Ashe Stadium.

    Clijsters has left Flushing Meadows as the champion each of the last three times she entered the field ? in 2005, 2009 and 2010. She missed the hard-court Grand Slam tournament in 2011 because of an injured stomach muscle. That's only one in a long line of ailments that have dogged Clijsters throughout her playing days, which she says will come to an end after the U.S. Open, no matter how well she fares.

    "It was a special occasion. ... I was nervous, maybe almost as much as she was," Clijsters said of facing Duval, who is ranked 562nd and was making her tour-level main-draw debut after winning the under-18 U.S. national championship.

    "I'm happy that I'm still here," Clijsters added, "and still winning some matches."

    It's not clear how much longer some other members of her generation will keep playing and winning ? players such as seven-time major champion Venus Williams, who is 32, and 2003 U.S. Open champion Andy Roddick, who turns 30 this week. Both were scheduled to be in first-round action on Tuesday, along with Williams' younger sister, 14-time major champion Serena, and defending champion Novak Djokovic.

    They'll be hoping to move into the second round as easily as 2006 champion Maria Sharapova did Monday, a nice change from the last time she was on a tennis court with something at stake.

    Playing for the first time since taking only one game from Serena Williams in a lopsided London Olympics gold-medal match, Sharapova needed barely more than an hour to deal with the whipping winds and, to a lesser extent, 88th-ranked Melinda Czink of Hungary.

    After her 6-2, 6-2 win, Sharapova went into a bit of a tongue-in-cheek discussion of the stomach virus that plagued her at the Summer Games and then forced her out of two hard-court tuneup tournaments this month.

    She went to the doctor for a series of tests, including an ultrasound to see if she was pregnant. The test turned up negative.

    "Just because of the pain I was having, it was really weird," said Sharapova, who is engaged to former NBA player Sasha Vujacic. "They told me I was fine, not pregnant. Then, I'm like, 'Can I get my money back?'"

    As for what could have been a real depressing defeat in the Olympic final, Sharapova said she's over it.

    "Doesn't stick with you," the third-seeded Russian said.

    A mostly low-intrigue Day 1 was about as bad as could be for the German contingent: The only top-20 seeded women who lost were No. 16 Sabine Lisicki and No. 18 Julia Goerges, while the only seeded man to exit was No. 22 Florian Mayer. He stopped because he felt dizzy and had blurred vision while trailing 19-year-old Jack Sock of the United States 6-3, 6-2, 3-2.

    "Overall, my physicality is better this year," said Sock, who teamed with Melanie Oudin to win the mixed doubles championship at the 2011 U.S. Open and has been working with Andre Agassi's former trainer, Gil Reyes.

    Both No. 1-seeded players won without any trouble, with 17-time major champion Roger Federer improving to 22-0 in U.S. Open night matches by overwhelming Donald Young of the U.S. 6-3, 6-2, 6-4, and Victoria Azarenka quietly getting past Alexandra Panova of Russia 6-0, 6-1.

    Before Federer held court on Ashe, it was Clijsters' turn.

    And Duval's.

    "I was freaking out," the bubbly, squeaky-voiced Duval acknowledged.

    Duval, who lives in Boca Raton, Fla., explained that being cheered by thousands of fans while walking out to face Clijsters was an "indescribable feeling."

    "It was much more than I expected. The whole atmosphere was just incredible," she said. "I was really nervous. But I thought I did a good job of not showing it."

    Young as she is, Duval has dealt with some trying life experiences already. She was born in Florida, but grew up in Haiti, where her parents were from, and as a kid, Duval and some cousins were taken hostage by robbers. Then, in January 2010, when a massive earthquake struck Haiti, her father was buried in rubble, his legs broken, but survived.

    "It helped my tennis in the sense that in those circumstances, we were just saying: No matter how tough things get, you're always going to get out of it.' So in my tennis, that's basically what I've been living by," Duval said. "No matter how down and out I am, I can get out of it."

    After dropping the first two games Monday, Duval took advantage of a series of forehand errors by Clijsters to take the next three for a 3-2 lead after 13 minutes.

    "Walking to the chair, I was like, 'I am actually up 3-2 right now!'" Duval said, her eyes closed as she replayed the moment in her mind.

    And then?

    "She definitely picked up her level a lot," Duval said. "She played like Kim Clijsters from that point on."

    Yes, the 23rd-seeded Clijsters would go on to win 10 of the last 11 games, wrapping up the match in 51 minutes while compiling a 23-1 advantage in winners.

    "If you hit one weak shot," Duval said, "it's pretty much, 'Bye-bye!'"

    The Basics, Interface
    Sony Music Unlimited offers a library of over 15 millions of songs on demand for those willing to pay the $9.99 per month Premium subscription. A lower-priced Basic membership is available for $3.99 per month, but it lacks on-demand playback, library building, playlist building, some genre-based channels, and other features that make Premium accounts worthwhile. Sony offers a 30-day trial if you want to dip your toe into the pool, but the lack of a truly free offering is a downer.

    The interface consists of album art arranged into five rows: A top spot (that rotates between Top Songs, Top Artists, and Top Albums), Recently Played Channels, Newly Added to My Library, New Releases, and You Might Like, the app's recommendation area. Navigation is a simple as swiping between rows and icons with a finger.

    The Listening Experience
    Tapping a song icon starts the music playback and displays the album art, song title, artist name, and runtime. There are also options that let you like or dislike a song, as well as add the song (or entire album) to a playlist or My Library. You can also cache those added songs for offline playback?a handy feature if you're outside 3G or Wi-Fi signal range. A column in the right portion of the screen houses related music that you should check out. The Home button in the upper-right hand portion of the screen reveals a menu bar with shortcuts that let you quickly jump between areas.

    Sony Music Unlimited's audio quality is surprising good, whether you listen through headphones or the PS Vita's speakers, and the tracks played smoothly over our office Wi-Fi connection. The music selection is impressive?I've found every album from The Dirtbombs, an indie Detroit-based rock band. There's comedy, too; Patton Oswald's three major comedy albums are also in the library, as well as other acts. Unfortunately, Sony Music Unlimited only has two of Joe Rogan's handful of comedy discs, so there are some gaps in the library.

    On the upside, playlists sync between the mobile app and the browser-based app, so your Sony Music Unlimited Experience remains the same across platforms.

    Nearly Unlimited Joy
    Sonic Music Unlimited is the lone streaming music service on the PS Vita?that alone makes it worth a look if you're into such things. That said, you need to plop down $9.99 per month if you want to get the most out of the service. If you do, you shouldn't be disappointed, despite a few album omissions.

    Astronomers Reassured by Record-breaking Star Formation in Huge Galaxy Cluster

    Until now, evidence for what astronomers suspect happens at the cores of the largest galaxy clusters has been uncomfortably scarce. Theory predicts that cooling flows of gas should sink toward the cluster's center, sparking extreme star formation there, but so far - nada, zilch, not-so-much.

    The situation changed dramatically when a large international team of over 80 astronomers, led by Massachusetts Institute of Technology's Hubble Fellow Michael McDonald, studied a recently discovered (yet among the largest-known) galaxy cluster.

    The team found evidence for extreme star formation, or a starburst, significantly more extensive than any seen before in the core of a giant galaxy cluster. "It is indeed reassuring to see this process in action," says McDonald. "Further study of this system may shed some light on why other clusters aren't forming stars at these high rates, as they should be."

    The result, published in the August 16th issue of the journal Nature, began developing in 2010 when data from the South Pole Telescope (SPT) allowed astronomers to identify the huge cluster of galaxies some 5.7 billion light-years distant. Designated SPT-CLJ2344-4243, it is among the largest galaxy clusters in the universe.

    "Our first observations of this cluster with the Gemini South telescope in Chile really helped to ignite this work," says McDonald. "They were the first hints that the central galaxy in this cluster was such a beast!"

    The paper's second author, Matthew Bayliss of Harvard University, adds, "When I first saw the Gemini spectrum, I thought we must have mixed up the spectra, it just looked so bizarre compared to anything else of its kind."

    Bayliss and Harvard graduate student Jonathan Ruel used the Gemini data to determine the cluster's distance; they also corroborated its huge mass with estimates from X-ray data obtained with the Chandra X-ray Observatory.

    Additional survey data from the National Optical Astronomy Observatory's (NOAO) Blanco Telescope in Chile augmented the early characterization of this cluster. A Blanco image of the cluster (Figure 1, top) is available as part of this press release.

    With this result, astronomers now believe they have finally seen, at least in this one large cluster of galaxies, what they expected to find all along - a massive burst of star formation, presumably fueled by an extensive flow of cooling gas streaming inward toward the cluster's central core galaxy.

    The sinking gas is likely sparking star formation and a lively, dynamic environment - somewhat like a cold front triggering thunderstorms on a hot summer's day. This is in rich contrast to most other large galaxy clusters where central galaxies appear to have stopped forming new stars billions of years ago - an uncomfortable discrepancy known as the "cooling-flow problem."

    According to theory, the hot plasma that fills the spaces between galaxy cluster members should glow in X-rays as it cools, in much the same way that hot coals glow red. As the galaxy cluster forms, this plasma initially heats up due to the gravitational energy released from the infall of smaller galaxies. As the gas cools, it should condense and sink inward (known as a cooling flow).

    In the cluster's center, this cooling flow can lead to very dense cores of gas, termed "cool cores," which should fuel bursts of star formation in all clusters that go through this process. Most of these predictions had been confirmed with observations-the X-ray glow, the lower temperatures at the cluster centers- but starbursts accompanying this cooling remain rare.

    SPT-CLJ2344-4243, nicknamed the "Phoenix Cluster, lies in the direction of the southern constellation Phoenix, which McDonald suggests is fitting. "The mythology of the Phoenix - a bird rising from the dead - is a great way to describe this revived object," says McDonald.

    "While galaxies at the center of most clusters may have been dormant for billions of years, the central galaxy in this cluster seems to have come back to life with a new burst of star formation."

    The team combined multiple ground- and space-based observations including data from the Gemini South 8-meter and the NOAO Blanco 4-meter telescopes, both in Chile and funded with support by the U.S. National Science Foundation (as is the South Pole Telescope which made the initial discovery of this galaxy cluster in 2010). Observations critical to this research also included the Chandra X-ray Observatory, NASA's WISE and GALEX observatories, and the European Space Agency's Herschel Observatory.

    After a bailiff cries ?all rise? and Judge David S. Doty strolls, marches, and/or glides into his Minneapolis courtroom the morning after the Giants host the Cowboys in the first game of the regular season, the NFL and NFLPA will get their first glimpse into the predispositions of the jurist who?ll decide whether or not the union?s surprising claim of a ?secret salary cap? in 2010 may proceed.

    It was a surprise because the claim came well after 2010 ended, and after the new CBA presumably wiped the slate clean between the league and the players, erasing all pending legal issues including any collusion claims that could have been made based on actual or perceived restraints on spending in a year that was supposed to have none.? (Technically, the labor deal imposed a handful of limits in 2010, such as restrictions on the free-agent signings by the teams finishing in the final eight from 2009.)

    It was a surprise also because the NFLPA had signed off on cap penalties imposed on the Cowboys and Redskins, penalties which revealed that the two teams were being punished because they didn?t comply with the ?spirit? of a salary cap that didn?t exist.? The union agreed with the penalties because the union desperately needed the NFL likewise to agree to a number-fudging that would allow the NFLPA to avoid the kind of reduction in the salary cap from 2011 to 2012 that would have been awkward, to say the least, as executive director DeMaurice Smith?s re-election approached.

    Now that the billable hours have hit the fan, Judge Doty will have to decide whether he?s more persuaded by technicality, or by equity.

    As framed by the NFLPA in its final written submission, a copy of which PFT has obtained, the players claim that the NFL didn?t do enough to engineer a release and waiver of claims for past collusion when the new CBA was finalized and all pending litigation was concluded in 2011.? Apart from whether the documents drafted by the parties contained the right magic words to make the claims for collusion in 2010 disappear, the NFLPA has advanced an intriguing argument based on the nature of class actions.? (Try to stay awake on this, please.? If it helps, the link on ?magic words? goes to a Bugs Bunny cartoon.)

    The union smartly argues that claims made on behalf of a class of litigants can be extinguished by court order only.? And so the union claims that, by not ensuring that Judge Doty would officially wipe out the collusion claims, the collusion claims weren?t wiped out.

    If Judge Doty agrees, it will mean that the league?s lawyers screwed up.

    Balanced against that technical application of the rules is fairness and common sense.? Regardless of the specific words or procedures used by the parties, the idea was to hit the reset button on all legal issues between the parties.? The league made concessions and the players made concessions and now the players are trying to avoid one of the concessions they made.? Some judges would decide, quickly, that such an outcome simply isn?t fair.

    Compounding the potential for a finding that the NFLPA is pushing for a fundamentally unfair outcome is the fact that the players gladly signed off on cap penalties that necessarily exposed the existence of collusion in 2010 in order to get something the NFLPA needed ? a higher salary cap in 2012.? It?s unseemly, to say the least, for the NFLPA to now try to use that which it gave up to get a high cap number as the basis for seeking billions in collusion damages for allegedly depressed spending in 2010, especially since it should have been obvious to anyone paying attention that something fishy was going on.

    Did the NFL engage in collusion in 2010?? Yes, in our opinion.? Should the NFLPA has done something about it in 2010?? Yes, in our opinion.? Is there something that doesn?t feel right about the NFLPA agreeing to the cap penalties that made the collusion crystal clear and then suing for collusion?? Absolutely.

    But what we/I/anyone else thinks doesn?t matter.? Judge Doty will provide the first official word on the issue.?     Obama's team seeks to counter GOP message

    WASHINGTON (AP) ? Democrats want to cause a stir ? or at least stay in the conversation ? while the spotlight is on Republicans next week at the GOP convention in Tampa, Florida.

    President Barack Obama and his campaign are seeking to counter Mitt Romney's message and try head off any dramatic climb for the Republican challenger in post-convention polls.

    Obama and Vice President Joe Biden will campaign in four battleground states. And Obama's campaign will hold events around the country aimed at women voters. The campaign also plans an economic-themed bus tour through Ohio, Pennsylvania and Wisconsin with party activists.

    In Tampa, Democrats plan daily events with party officials and middle-class Americans to counter the Republican ticket. The activity will lead into the Democratic National Convention in Charlotte, N.C., beginning Sept. 4.

    What Do Homophobic Bigots Really Think?

    There were thousands of comments in response to my last piece at Slate, in which I lashed out against Chick-fil-A president Dan Cathy?s policy of funding anti-gay causes. I tried to dip in and out of the comment thread as often as I could while they were piling up, scanning them for interesting points (of which there were many). But I quickly lost track and had to get back to work on other projects.

    Then a reader sent me a link to a discussion of my article at the popular conservative website Free Republic. It?s pure masochism for someone like me to wander such halls; I don?t need to read their posts to know just what ultraconservatives think of my ?homosexualism? and me. But curiosity got the better of me. And my, my, my, they really do hate us queers over there. It?s not just Free Republic, of course. Similar anti-gay sentiments are a staple of many gathering places online, not to mention those in the real world.

    People are free in this country to say what they will, nasty though it is, about gays and lesbians. What to do about it, then? I believe that treating bigots as scientific specimens is the best way to disarm their hate. I can?t tackle all such propaganda in a single article (I won?t be able to cover the all-gay-men-are-pedophiles argument, the-all-lesbians-just-hate-men argument, or the next-thing-you-know-we?ll-all-be-marrying dogs-and-horses argument), but for now I?ll dissect some of the other common rhetorical devices deployed by those with an anti-gay mindset.

    So without further ado, let?s put these mean bastards under the psychological knife.

    The homosexuality-as-choice argument: Those who repeatedly make this claim are actually revealing something about their own sexuality: they are bisexual. Since human beings use a form of mental analogy whenever trying to understand another person?s behavior, the ?choice? argument reflects the reasoning process of an individual who has experienced notable arousal to the same sex in addition to the opposite sex, but has chosen to act only on that inspired by the latter. A true heterosexual, by contrast, has never experienced meaningful same-sex desires and understands that one cannot choose to act on what is simply not there.

    The secret bisexuality of those who just cannot seem to grasp that being gay is not, in fact, a choice also helps us to understand the intense hostility that some males feel for openly gay men. Research has shown a positive correlation between a man?s loathing of gay men and his own repressed same-sex desires. ?Since homosexual behavior violates both their moral code and their sense of identity,? explained the psychologists Donald Mosher and Kevin O?Grady long ago, ?homosexual threat is experienced as men become aware at some level of their ? arousal to homosexual stimuli. This awareness can be avoided by anger, disgust, and contempt directed against homosexuals, as a means of bolstering hypersexual identity.? The psychologist Henry Adams has used a device called a plethysmograph that measures penile arousal to show that the more aversion a man says he feels toward gay men?and even more disturbingly, the more willing he is to inflict pain upon them?the more intense is his erection to gay porn.

    The homosexuality-is-disgusting argument: One of the most potent propaganda devices is the age-old ploy of dehumanizing the oppressed party by stirring up feelings of disgust for them. The Nazi author of an animated children?s book from 1938 Germany, for example, wrote this for his young readers: ?Just look at these guys! The louse-infested beards! The filthy, protruding ears, those stained, fatty clothes ? Jews oftentimes have an unpleasant sweetish odor. If you have a good nose, you can smell the Jews.? (The author was later executed as a war criminal.)

    In our own country?s lamentable past, disgust rhetoric slowed down the hard-won civil rights achievements of women and blacks. In the present case, scatological language litters antigay conversations, along with the portrayal of gay men as being unique carriers of ?horrific diseases? such as AIDS. Over at Free Republic, for example, you?ll read comment after comment such as these:

    * If your personal identity revolves around your lust for other men?s stinking anuses, a particularly disgusting form of depravity that spreads horrific diseases, the chest swells with self-satisfaction. What a sick world we live in.

    * homosexuals should never have got their special rights like civil unions let alone marriage or don?t ask in the first place. The ignorant and stupid on our side wanted to appease them because as they usually say ?I know a couple and they are nice? friggin idiots, so when did we base special rights based on fecal diseased sex in the constitution?

    Negative Equity Declines Slightly On the Back of Modest Home Value

    The housing market is finally showing signs of life, with many metropolitan areas having hit the elusive bottom and seeing home value appreciation, however negative equity remains a drag on the housing market. According to the second quarter Zillow Negative Equity Report, 30.9 percent of U.S. homeowners with a mortgage are underwater (see Figure 1) ? 14.9 million people ? in the second quarter of 2012. Recent home value appreciation in many markets across the US has pushed negative equity levels down from 31.4 percent last quarter. However, negative equity is still slightly elevated from the 2011 Q2 percentage of 30. In total, underwater homeowners owe $1.1 trillion more than their homes? worth. Over 40 percent of underwater homeowners (12.5 percent of all homeowners with a mortgage), owe between 1 and 20 percent more than their home is worth. On the other end of the spectrum, about 2.2 million underwater homeowners (4.5 percent of all homeowners with mortgages) owe more than double what their home is worth (see Figure 2). On average, U.S. homeowners in negative equity owe $75,235 more than what their house is worth, or 43.9 percent more (see Table 1). While roughly one out of every three homeowners with mortgages is underwater, 91 percent of these homeowners are current on their mortgage and continue to make payments.

    The Zillow Negative Equity Report incorporates mortgage data from TransUnion, a global leader in credit and information management, to calculate various statistics. The report includes, but is not limited to, negative equity, loan-to-value ratios, and delinquency rates. To calculate negative equity, the estimated value of a home is matched to all outstanding mortgage debt and lines of credit associated with the home, including home equity lines of credit and home equity loans. All personally identifying information (?PII?) is removed from the data by TransUnion before delivery to Zillow. Overall, this report covers over 800 metros, 2,100 counties, and 22,200 ZIP codes across the nation.

    Regional Trends

    The extent to which U.S. homeowners are underwater varies greatly by region. High rates of negative equity have accumulated in states such as California, Florida, Nevada, Arizona, and Georgia ? some of the hardest hit areas of the housing recession, where home values have fallen dramatically from peak. As home values fall, negative equity increases. In 36 out of 787 metros, more than half of all homes with mortgages in the metro are underwater. Among these regions are larger metros such as Las Vegas (69.5 percent), Atlanta (54.4 percent), Orlando (51.9 percent), Phoenix (51.6 percent), and Riverside (51.2 percent). See Table 1 for summary statistics in the top metro regions.

    Drilling down to the metro level there is a wide variation in negative equity with the percent of underwater borrowers ranging from 4.7 to 69.7 percent. Among the least underwater metros are Bismarck, ND, State College, PA, and Honolulu, HI. On the other end of the spectrum are markets like Las Vegas, NV and Merced, CA. One out of every four homeowners with a mortgage in the Las Vegas metro owes more than twice the amount of their home?s value. In Merced, one out of every five homeowners owes more than twice the amount in their home?s value. Figure 4 provides an overview of distribution of the loan-to-value ratio for the largest metropolitan areas (a loan-to-value ratio greater than 100 percent means that the homeowner is underwater).

    While negative equity makes a household more vulnerable to foreclosure, most homeowners in negative equity will not end up in default. The majority of underwater homeowners continue to make regular payments on their mortgage, with only 9.2 percent of underwater homeowners being delinquent. This implies that 2.9 percent of all homeowners with a mortgage are at high risk for foreclosure near-term. Figure 3 shows a breakdown of these numbers for the top 30 metros.

    In terms of historical performance, we saw negative equity significantly decrease in some metropolitan areas while it continued to increase in others. These movements are highly correlated with home value movements. As home values in Phoenix have been aggressively rising, negative equity has continued to recede, falling from 55.5% in the first quarter to 51.6% in the second quarter.

    Outlook

    With unemployment remaining flat or even rising in some parts of the country, negative equity remains a major factor in the housing market as the combination of negative equity and elevated unemployment spawns fresh foreclosures. With evidence of foreclosure starts increasing in many parts of the country, even while foreclosure liquidations continue to decline, we do expect this dynamic to put downward pressure on the negative equity rate (as homes in negative equity are foreclosed, sold in short sales, or have their principals reduced in a modification process).? Downward pressure on negative equity from ongoing foreclosures processes will be amplified by modest increases in home values over the coming few years.
