Schott is offering a severance package of two months of pay and benefits, but a lot of folks leaving told Action 7 News that is far different than having a place to show up every day. When the company announced plans for a plant back in 2008, it was thought that the facility would employ 1,000 New Mexicans.? Actor Don Grady of 'My Three Sons' dies at 68

Actor Don Grady died Wednesday at the age of 68. Grady passed away in L.A. after a long battle with cancer, his family confirmed to Deadline.

The actor was most well-known for his role as Robbie Douglas in "My Three Sons" and was one of the original Mouseketeers on "The Mickey Mouse Club." He joined the show when he was only 13 years old.

Grady landed his role on "My Three Sons" in 1960 and pursued a career in music when the show ended in 1972. He recorded an album with his collection of songs, "Homegrown," in 1973. In 2008, he released a collection of songs about the baby boomer generation, titled "Boomer."

Wall Street likes, doesn't love, Facebook

SAN FRANCISCO (Reuters) - Facebook Inc drew tepid assessments from Wall Street's top analysts a month after its rocky stock market debut, as warnings about an uncertain business model and a difficult transition to mobile helped send its shares down 2.6 percent.

In more than a dozen highly anticipated reports, Morgan Stanley and other major brokerages that handled the blockbuster IPO said it remains unclear how Facebook plans to make money from a growing number of users logging onto the No. 1 social network via smartphones and tablets.

Most analysts expected Facebook's large user base to help it corner a substantial share of the Internet advertising market. But almost half of the ratings released on Wednesday were "hold" or the equivalent -- despite the shares trading sharply down from their $38 IPO price.

The reports, all from banks involved in the highly anticipated but poorly executed IPO, represent Wall Street's most broad-based assessment of Facebook, the first U.S. company to debut with a market value of more than $100 billion.

The 33 banks that participated in the stock listing were required by securities regulations to wait until 40 days after the first day of trading on May 18 before publishing their views, limiting the research on Facebook until now to a handful of analysts.

"One of the things investors will have to get comfortable with is Facebook's recent revenue growth deceleration," said Scott Devitt at lead underwriter Morgan Stanley, who issued an "overweight" rating.

Devitt, who told the firm's major clients that he had cut his revenue estimates on Facebook just days before the IPO, said he expects mobile monetization to be a challenge for the next several quarters to several years.

He expects revenue to climb 31 percent in 2012, down sharply from the 88 percent growth in 2011.

Of 14 analysts' ratings initiated overnight or early on Wednesday, seven slapped top ratings -- "buy," "outperform" or "overweight" -- on the social networking company, including lead advisors JP Morgan, Goldman Sachs and Morgan Stanley.

Six others, including Citi, gave Facebook a "neutral" or "hold" rating. And just one -- BMO Capital Markets -- began their coverage with an "underperform" recommendation and a $25 target, translating into a nearly 25 percent slide from current levels.

The eight-year-old company started by Mark Zuckerberg in his Harvard dorm-room began trading at $38 -- a whopping 100 times 2011 net income per share, compared with Apple Inc's current multiple of 20.6 and Google Inc's 18.9.

TOPSY TURVY IPO

Analysts at JP Morgan set a price target of $45 for the stock, suggesting a rise of 36 percent compared with its close of $33.10 on Tuesday. Facebook shares were down 2.6 percent at $32.23 in morning trading on Wednesday.

The company's stock offering, one of the most highly anticipated in history, was marred by a series of technical glitches at the Nasdaq exchange.

Facebook's decision to increase the size of the offering by 25 percent just days ahead of the IPO, as well as concerns about decelerating revenue, also weighed on the stock, which traded as low as $25.52 before regaining some ground to trade in a $31-$33 range in recent days.

Goldman Sachs set a share price target of $42, while RBC said it expected a run to $40. BofA Merrill Lynch and Morgan Stanley pegged the shares at $38, while Citi and Barclays opted for $35.

The rush of research comes ahead of Facebook's second-quarter results, expected sometime in mid to late July.

With about 900 million users, Facebook has become one of the Web's top destinations, challenging established players such as Google Inc and Yahoo Inc .

Even so, revenue growth from ads and other services is slowing. The company, which last year was more than doubling the amount of money collected every quarter compared with a year earlier, reported growth of 45 percent in the first three months of 2012, and revenue declined from the preceding quarter.

General Motors' announcement a few days before the IPO that it would stop advertising on Facebook has added to the concerns about Facebook's ability to generate business from advertising.

Despite $4.8 billion in expected revenue in 2012, Facebook's user monetization rate is still relatively low, said BofA Merrill Lynch, which expects new advertising formats to accelerate revenue growth in the second half of the year.

In recent weeks, Facebook has unveiled a string of enhancements to its advertising service, allowing marketers to target ads to users on the mobile version of Facebook and to show Facebook users ads based on previous websites that they have visited.

"The company is in the midst of a mobile usage transition and we are cautious on Facebook's revenue trends until new mobile ad revenue models start driving the top line," the analysts at BofA Merrill Lynch wrote.

Several analysts working for the underwriters, including Morgan Stanley and Goldman Sachs, cut financial forecasts for Facebook days before the IPO after the company cautioned about revenue growth due to a rapid shift of users to mobile devices, where Facebook is less effective at generating revenue.

The analysts briefed some institutional clients about their revised forecasts, Reuters has reported, but retail investors were left in the dark. That revelation has resulted in lawsuits alleging the banks and Facebook failed to fully disclose the company's weakened financial outlook ahead of its IPO. Whether the Olympics are around the corner (as they are now) or a few years away, there are always Olympic-themed events going on. Recently, a group called Ravelry sponsored a knitting competition called the ?Ravelympics.? [Related post on Ravelry: "Is There an Elitist Oligarchy in the Underworld of Knitters?"] Whereas most people probably imagined a bunch of grandmothers knitting mufflers, the U.S. Olympic Committee saw a conspiracy to infringe its trademark in the word ?Olympics.?

After enduring a lot of criticism, the USOC backed off the knitters. But what the USOC tried to do isn?t unusual.

In fact, just recently luxury goods purveyor Louis Vuitton threatened to sue Penn law school over a poster for an academic conference on the law of fashion that featured an artist?s funny take on the Louis Vuitton logo (with the famous ?LV? replaced with a ?TM?). Louis Vuitton didn?t see the joke, and threatened the law school (which, being a law school, knew enough not to be scared).

Many trademarks are so zealously (over)enforced that it sometimes seems crazy. Which raises the question: why do brands (and their lawyers) do this?

The answer involves the interaction between a quirk in trademark law and the culture of lawyers.

First, the law: A few courts have held that even minor failures or delays in aggressively enforcing trademark rights can be evidence of the mark holder?s acquiescence in uses that would otherwise be unlawful. In other words, if you don?t act like a pit bull in defense of your mark, you may be seen as tacitly accepting its use by others. Courts are not consistent ? indeed, in some cases, mark holders with a clear record of non-enforcement have been given a pass.? And so you might expect lawyers to advise their clients that the benefits in time and money saved ? and bad publicity avoided ? by ignoring small fry such as knitters is probably worth it. But instead, lawyers are apt to overreact to even a few rulings that go against trademark owners.?

Why? For one, lawyers get paid for doing something, not for doing nothing. So lawyers are incentivized to advise their clients that every unauthorized use of a trademark, no matter how silly or obscure, must be dealt with lest the trademark owner later be found to have acquiesced.?

And this creates a sort of strange feedback loop. What looks initially like overenforcement of trademarks ? that is, sending cease and desist letters and filing lawsuits in cases where no one thinks the trademark owner is really going to be harmed ? begins to look more like normal behavior.?

This is why no one was surprised by Louis Vuitton?s reaction to the law school poster.?? The poster was perfectly lawful, and Louis Vuitton came away looking silly. But don?t expect that to change any time soon, because the habit of trademark overenforcement seems to be deeply engrained by now. With the Olympics opening in just over a month, stay tuned to see many more ham-handed enforcement efforts.?

Tropical Storm Debby drenches Florida

TAMPA, Fla. (AP) ? Practically parked off Florida's Gulf Coast since the weekend, Tropical Storm Debby raked the Tampa Bay area with high wind and heavy rain Monday in a drenching that could top 2 feet over the next few days and has already led to flooding.

At least one person was killed Sunday by a tornado spun off by the large storm system in Florida, and Alabama authorities searched for a man who disappeared in the rough surf.

An estimated 35,000 homes and businesses lost electricity. But as of midafternoon, the slow-moving storm had caused only scattered damage, including flooding in some low-lying areas.

The National Hurricane Center reported late Monday that torrential rains and flooding would continue for the next several days across parts of the Florida Panhandle and north Florida.

The bridge leading to St. George Island, a vacation spot along the Panhandle, was closed to everyone except residents, renters and business owners to keep looters out. The island had no power, and palm trees had been blown down, but roads were passable.

"Most true islanders are hanging in there because they know that you may or may not be able to get back to your home when you need to," said David Walker, an island resident having a beer at Eddy Teach's bar. He said he had been through many storms on the island and Debby was on the weaker end of the scale.

Gov. Rick Scott declared a statewide emergency, allowing authorities to put laws against price-gouging into effect and override bureaucratic hurdles to deal with the storm.

By 11 p.m. Monday, Debby was in the Gulf of Mexico, 35 miles (56 kilometers) south of Apalachicola, with sustained winds around 45 mph (72 kph), according to the hurricane center. It was moving northeast at 2 mph (3 kph)

A tropical storm warning remained in effect Monday evening from Mexico Beach in the Panhandle to Englewood, south of Sarasota.

Forecasters cautioned that Debby is a large tropical cyclone spreading strong winds and heavy rains at great distances from its center.

They said it would crawl to the northeast, come ashore along Florida's northwestern coast on Wednesday and track slowly across the state, exiting along the Atlantic Coast by Saturday morning and losing steam along the way.

Parts of northern Florida could get 10 to 15 inches of rain, and some spots as much as 25 inches, as the storm wrings itself out, forecasters said.

"The widespread flooding is the biggest concern," said Florida Emergency Operations Center spokeswoman Julie Roberts. "It's a concern that Debby is going to be around for the next couple of days, and while it sits there, it's going to continue to drop rain. The longer it sits, the more rain we get."

High winds and the threat of flooding forced the closing of an interstate highway bridge that spans Tampa Bay and links St. Petersburg with areas to the southwest.

Monday evening, the state announced the closing of the Howard Frankland bridge that connects Tampa, including the region's major airport, and St. Petersburg. The eight-lane bridge carries Interstate 275 over Tampa Bay. The southbound lanes were later reopened.

People in several sparsely populated counties near the crook of Florida's elbow were urged to leave low-lying neighborhoods because of the danger of flooding. Shelters opened in some places.

On St. Pete Beach in the Tampa Bay area, surfers enjoyed the large waves in the Gulf, which is usually so calm the water looks like glass. Residents cleaned up debris in yards and streets from a possible tornado Sunday.

"The wind picked up so bad. It's very, very scary. I ran into the closet underneath the hallway stairs," said Ann Garrison, who has lived on the barrier island for 20 years but has never seen such strong winds. She said that when she came back out after just a few minutes, "the fence was gone, and it was in the middle of the yard."

Nearby, a likely tornado ripped the roof off a marina and an apartment complex and knocked down fences, trees and signs.

Kourosh Bakhtiarian's yard was flooded. He said people were driving around the neighborhood to gawk at the damage, and he complained that police hadn't closed off the streets.

"We have a lot of visitors from outside of this area. They just want to see exactly where the disaster is. I mean, this is not the happiest time," he said.

On St. George Island, many businesses were closed, but Eddy Teach's bar had a few customers and used a generator to keep beer and food cold.

"The tourists cleared out. It's not a good thing and hurts the economy during a week in peak season," said Patrick Sparks, a manager at the bar. He scoffed at the storm, which was well below the 74 mph threshold for a hurricane: "It's a little rash to send everyone home."

Ballmer calls it a "viral adoption model." He's CLEARLY excited about having people who can teach Microsoft how to do it.

"What they've done is amazing," Ballmer said. Yammer is "very unique" among companies that sell their wares directly to users. "You can't find anyone who's really built virally that still has great respect from the IT department and love from the users."

It's very easy for IT guys?who make their living supporting the hardware and software their colleagues use?to get touchy about rogue employees using unapproved software and services. Yammer has largely avoided that, Ballmer is suggesting.

Ballmer repeated that idea a bunch of times adding that Yammer's "adoption model" was something that Microsoft was "excited about and want to pour more content into it."

He compared it to Office 365?which is sold to enterprises the classic way, through some form of enterprise contract. That's in part because there are options with Office 365 which require per-computer licenses of Microsoft Office products.

Viral adoption is a pretty new model for Microsoft. Microsoft is clearly hoping Sacks can teach it this new trick.

Luck in the NBA?s draft lottery is relative, and nobody understands this more than the Spurs.

They won the 1987 lottery, when David Robinson was the prize. That guaranteed more than a decade at an elite level, even if they had to wait two years before The Admiral could don silver and black.

When they won the lottery again in 1997 and Tim Duncan was coming out, they knew they had a shot at winning multiple titles.

Other lottery winners haven?t been so lucky with their timing.

Take the 2001 Wizards.

When Kwame Brown is the first player to shake David Stern?s hand on draft night, you?re better off to pick last in the first round. That allows you to select an unknown French point guard who would help Duncan win three of his four NBA titles.

The Hornets got plenty lucky last month when they won the lottery in a draft that has only one franchise changer. There are those who already believe Anthony Davis can change the Hornets as dramatically as Duncan changed the Spurs in 1997.

Everyone needs to understand Duncan is an all-time top-10 player and give Davis, the one-and-done Kentucky star, a bit of a break. He may share Duncan?s build, temperament and skill set, but Duncan led the Spurs to four championships in his first 10 seasons.

Perspective, please.

Duncan didn?t come out of a one-player draft, but he was the only true franchise changer. Chauncey Billups, the No. 3 choice, eventually would become its second-best player, win a Finals MVP Trophy and may some day go into the Hall of Fame, as Duncan certainly will. But he was hardly a draft-night franchise changer. It took him three trades and six teams before he won a title.

Davis is the only franchise changer in the re-stocking process that will take place Thursday night in Newark, N.J. Behind him are players who are potential NBA starters, but talk to a half dozen NBA GMs and there is no consensus on which players will be in the top five, and never mind the order.

Will the Bobcats use the second pick to try and rebuild around Kansas power forward Thomas Robinson? Or will Michael Jordan opt for Florida shooting guard Bradley Beal, a player who might remind him a bit of himself?

Is the upside potential of Connecticut 7-footer Andre Drummond enough to get him into the top five? Or will the consensus that he is years away from making an impact keep him in the second five?

Basketball experts with no reason to deceive call Thursday?s proceedings a one-player draft. Others believe there are players who can be solid role players ? Shane Battier types, one GM said ? for years to come.

?I think this draft is going to surprise some people,? said an Eastern GM. ?There are a lot of long-term rotation guys in the top 10.?

?It?s deeper than you might think at first glance,? said a Western GM. ?You can get pretty excited about five to 10, even some guys from 10 to 15.?

Could there possibly be a player left at pick No. 59, when the Spurs are slated to make their lone pick?

?R U kidding?? a team talent scout texted during a break from watching potential draftees on Saturday afternoon. ?Nobody knows what Spurs will do.?

What every NBA scout knows is this: Davis is clearly the class of the Draft Class of 2012.

?The dropoff from one to two is steep,? said one player personnel chief.

Already, Davis has changed not one, but two franchises.

To ensure there would be no ambivalence about Davis? role in New Orleans, the Hornets traded center Emeka Okafor to the Wizards in exchange for grossly overpaid Rashard Lewis, with Trevor Ariza thrown in to make the money work.

Suddenly, Washington has two new starters and reason to believe next season won?t be another exercise in futility.

That?s the dual power of one franchise changer.
